MSEDCL to Appeal in Supreme Court in its Litigation with Laxmi Organic Industries

Laxmi Organic Industries Ltd. announced a key update in relation to the ongoing legal battle with Maharashtra State Electricity Distribution Company Ltd (MSEDCL), after the latter’s decision to escalate the dispute to the Hon’ble Supreme Court of India.

The dispute is based on an October 24, 2024 order of the Appellate Tribunal for Electricity (APTEL) in favor of Laxmi Organic. MSEDCL, in turn, has filed a Special Leave Petition (SLP) being Diary No. 61237/2024 challenging the order of APTEL. The issue is likely to come for further hearing but no date has been fixed by the apex court.
Continued Levy Prompts Legal Action
Despite the APTEL judgment, MSEDCL has continued levying Wheeling Charges, Wheeling Losses, and Transmission Charges and Losses—an action Laxmi Organic contests as illegal. Initially, the company sought recourse through a Contempt Petition at APTEL. However, the tribunal dismissed the plea, citing its lack of civil contempt jurisdiction under the Contempt of Courts Act.
Subsequently, Laxmi Organic escalated the matter by filing Writ Petition (L) No. 14504 of 2025 before the Hon’ble Bombay High Court. The court has scheduled the next hearing for June 10, 2025.
No Implications on Promoters or Management
The litigation does not involve any key management personnel, promoters, or individuals in control of the company, nor has there been any settlement that would impact the financials of Laxmi Organic Industries Ltd at this time.
